These terms and conditions constitute an electronic record in the form of an electronic contract under the Information Technology Act, 2000 and the rules made thereunder, including the amended provisions pertaining to electronic documents/records in various statutes as amended by the Information Technology Act, 2000.
This document shall be construed in accordance with the provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data of Information) Rules, 2011 under the Information Technology Act, 2000. These rules require the publishing of the privacy policy for collection, use, storage, and transfer of sensitive personal data or information.

We may change or end any Service or modify our prices prospectively. We may change, suspend or discontinue any of our Services. We may also modify our prices effective prospectively upon reasonable notice to the extent allowed under the law.
We don’t promise to store or keep showing any information and content that you’ve posted. PENSION PLUS is not a storage service provider. You agree that we have no obligation to store, maintain or provide you a copy of any content or information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.
You acknowledged PENSION PLUS may use the data collected in the course of our relationship for the purposes identified in our privacy policy, which is incorporated by reference as if fully set forth in these terms of use.
For your personal information we use proper security measures and apply ISO 270001: 2013 standard which assured you we follow the entire standard and it gives you assurance that we keep your information safe and secure.

PENSION PLUS, its affiliates, and technology partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of the “Ask AI Advisor” feature. This service is developed and operated from India. Users accessing the application from other jurisdictions do so at their own risk and are responsible for compliance with their local laws. PENSION PLUS makes no representation that the feature is lawful or available for use outside of India.
The “Ask AI Advisor” feature shall not be used to generate or disseminate harmful, misleading, illegal, or unethical content. Any misuse, including attempts to manipulate or circumvent the system, may result in suspension of access or legal action under applicable laws.
To enhance user experience and to ensure that the advice provided through the “Ask AI Advisor” feature is accurate, relevant, and compliant with applicable legal and regulatory frameworks, the PENSION PLUS application and website may request access to your geographic location.

To the fullest extent permissible pursuant to applicable law. PENSION PLUS and its affiliates disclaims all warranties of any kind, whether express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement. Except as otherwise agreed in writing, and its affiliates assume no responsibility for and make no warranty or representation as to the accuracy, currency, completeness, reliability or usefulness of any advice, opinion, statement or other content or of any products or services distributed or made available by third parties through the Application. PENSION PLUS does not make any warranty that this Application or its content will meet your requirements, or that this Application or its content will be uninterrupted, timely, secure, or error free, or that defects, if any, will be corrected. Nor does makes any warranty as to the results that may be obtained from use of this Application or its content or as to the accuracy, completeness or reliability of any information obtained through use of this Application. Application maintenance/Technical charges are applicable to the subscriber of PENSION PLUS.
Please be aware that text that originated from external sources and was imported into a Project may be under a license that attaches additional attribution requirements. Users agree to indicate these additional attribution requirements clearly. Depending on the Project, such requirements may appear for example in a banner or other notations pointing out that some or all of the content was originally published elsewhere. Where there are such visible notations, re-users should preserve them. Also, there is no intention or purpose of violating any intellectual property or ancillary rights.
Best efforts are taken by our team to track each and every public notice published in newspapers, the list of which appears on the Application. There may be a very remote possibility that any particular notice may be missed despite our best efforts due to some human or technical error for which PENSION PLUS will not be held liable or accountable. There is also a remote possibility that a certain public notice may not be viewed properly due to some apparent defect from its source for which PENSION PLUS will not be liable. While we are trying our best endeavour to exhibit the public notices on the day itself when the same are published in the newspapers mentioned on our Application, however, due to some reasons beyond the control of PENSION PLUS, there may be a delay in exhibiting the public notices and the entry of the notices on the Application for which PENSION PLUS will not be liable. There might be a possibility that the users subscribed for alert plus may not receive any alert if there is even slightest discrepancy in inserting the details of the property by the user and the public notice actually published. For receiving alerts, the details inserted should totally match the public notice published. PENSION PLUS will not be held liable for non-receipt of any alert due to any discrepancy.
In addition to this PENSION PLUS & its directors, employees, agents, representatives and the authors and its affiliates and associates shall not be liable, at any time for damages arising in contract, tort or otherwise from the use of or inability to use the Application, or any of its con-tents, or from any act or omissions as a result of using the Application or any such contents or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on the Application. PENSION PLUS & its directors, employees, agents, representatives disclaim all any all direct, indirect, special, consequential damages, loss arising from use the services provided by PENSION PLUS. Further the subscribers shall not be entitled for any refund of any amount or any compensation etc. if PENSION PLUS is required to shut down its operations and service due to some government policy or due to any act beyond the control of PENSION PLUS.
Under no circumstances, including, without limitation, negligence PENSION PLUS, shall PENSION PLUS or its parents, subsidiaries, affiliates, officers, directors, employees, PENSION PLUS, or suppliers be liable for any direct, indirect, incidental, special or consequential PENSION PLUS arising from or in connection with the use of or the inability to use this Application or any content contained on the Application, or resulting from unauthorized access to or alteration of your transmissions or data, or other information that is sent or received or not sent or received, including but not limited to, damages for loss of prof-its, use, data or other intangibles, even if PENSION PLUS has been advised of the possibility of such PENSION PLUS.
The parties acknowledge PENSION PLUS that this is a reasonable allocation of risk. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or con-sequential PENSION PLUS, so some of the above may not apply to you.
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this terms and conditions or the program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this terms and conditions and the program will not exceed the total referral fees paid or payable to you under this terms and conditions.
These terms of use shall be governed by and construed in accordance with the laws of India. You agree to submit to the personal and exclusive jurisdiction of the Indian courts located within Pune, India. These terms constitute the entire agreement between you and PENSION PLUS governing your use of the Application.
You agree that any claim arising out of or related to these terms or your use of the Application must be filed within one year after it arose or be permanently barred.
When you visit PENSION PLUS or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on this Application. You agree that all terms and conditions, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.
All content included on this Application, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, hardware, and equipment is the property of PENSION PLUS or its content suppliers and is protected by international copyright laws.

All other trademarks not owned by PENSION PLUS that appear on this Application are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by PENSION PLUS or its subsidiaries.
PENSION PLUS grants you a limited license to access and make personal use of this Application and not to download or modify it, or any portion of it, except with express written consent of PENSION PLUS. This license does not include any resale or commercial use of this Application or its contents: any collection and use of any product listings, descriptions, or prices: any derivative use of this Application or its contents: any downloading or copying of account information for the benefit of another merchants or customers: or any use of data mining, robots, or similar data gathering and extraction tools and malware or virus or penetration testing. This Application or any portion of this Application may not be reproduced, duplicated, copied, sold, resold, viApplicationd, or otherwise exploited for any commercial purpose without express written consent of PENSION PLUS. Any unauthorized use terminates the permission or license granted by PENSION PLUS. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of PENSION PLUS so long as the link does not portray PENSION PLUS, it’s associates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any PENSION PLUS logo or other proprietary graphic or trademark as part of the link without express written permission.

As a condition to your participation in the program, you agree that while you are a program participant you will comply with all laws, ordinances, rules, regulations, orders, licenses, permits, judgments, decisions or other requirements of any governmental authority that has jurisdiction over you, whether those laws, etc. are now in effect or later come into effect during the time you are a program participant. Without limiting the foregoing obligation, you agree that as a condition of your participation in the program you will comply with all applicable laws of India that govern marketing email and all other anti-spam laws.
Our Application/portal function as intermediaries as defined under sub-clause(w) of section 2 of the Information Technology Act, 2000(IT Act). As per section 2(1) (w) of Information Technology Act, 2000, an “intermediary” with respect to any particular electronic record, means any person who on behalf of another person receives, stores or transmits that record or provides any service with respect to that record.
The terms of this terms and conditions will begin upon our acceptance of your program application and will end when terminated by either party. Either you or we may terminate these terms and conditions at any time, with or without cause, by giving the other party written notice of termination. Upon the termination of this terms and conditions for any reason, you will immediately cease use of, and remove from your Application, all links to the PENSION PLUS Application, and all of our trademarks, trade dress, and logos, and all other materials provided by or on behalf of us to you pursuant hereto or in connection with the program. You are eligible to earn referral fees only on sales of qualifying products that occur during the term, and referral fees earned through the date of termination will remain payable only if the related orders are not canceled or returned. We may withhold your final payment for a reasonable time to ensure that the correct amount is paid.
We may modify any of the terms and conditions contained in this terms and conditions, without prior notice at any time and in our sole discretion, by posting a change PENSION PLUS notice or a new terms and conditions on the PENSION PLUS Application. Modifications may include, for example, changes in the scope of available referral fees, referral fee schedules, payment procedures, and program rules. If any modification is unacceptable to you, your only recourse is to terminate this terms and conditions. Your continued participation in the program following our posting of a change notice or new terms and conditions on the PENSION PLUS Application will constitute binding acceptance of the change in PENSION PLUS.
You and we are independent contractors, and nothing in this terms and conditions will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your Application or otherwise, that reasonably would contradict anything in this clause.
The community plays the primary role in creating and enforcing policies that apply to the different Project editions. PENSION PLUS rarely intervenes in community decisions regarding policy or enforcement. However, in exceptional cases—particularly where there is significant disruption or dangerous behavior—we reserve the right, but are not obligated, to:
In the interests of our users and the Projects, in the extreme circumstance that any individual has had his or her account or access blocked under this provision, he or she is prohibited from creating or using another account on or seeking access to the same Project, unless we provide explicit permission. Without limiting the authority of the community, the Wikimedia Foundation itself will not ban a user from editing or contributing or block a user's account or access solely because of good faith criticism that does not result in actions otherwise violating these Terms of Use or community policies.
PENSION PLUS and its members may also take action when so allowed by the community or Foundation policies applicable to the specific Project edition, including but not limited to warning, investigating, blocking, or banning users who violate those policies.
Especially problematic users who have had accounts or access blocked on multiple Project editions may be subject to a ban from all of the Project editions, in accordance with the Global Ban Policy. In contrast to Board resolutions or these Terms of Use, policies established by the community, which may cover a single Project edition or multiple Projects editions (like the Global Ban Policy), may be modified by the relevant community according to its own procedures.
You acknowledge that you have read this terms and conditions and agree to all its terms and conditions. You understand that we may at any time (directly or indirectly) solicit customer referrals on terms that may differ from those contained in this terms and conditions or operate Application that are similar to or compete with your Application. You have independently evaluated the desirability of participating in the program and are not relying on any representation, guarantee, or statement other than as set forth in this terms and conditions.
Please review our other policies, such as our Privacy Policy. These policies also govern your visit to PENSION PLUS. We reserve the right to make changes to our Application, policies, and these conditions of use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
